The first law on a register of beneficial owners of legal entities in Liechtenstein came into force in 2019.
When a business relationship is established, the founder, settlor or trustor are always deemed to be the beneficial owner. This applies regardless of whether they exercise control over the legal entity after it has been established.
Who has the right to inspect this directory?
- Financial Intelligence Unit (FIU)
- Finanzmarktaufsicht (FMA)
- State police
- Tax administration
- Public prosecutor’s office
- Court
so far as this is necessary to combat money laundering, its predicate offenses and terrorist financing.
Third parties must have a legitimate interest.
The FMA may verify the material accuracy of the data in the register via due diligence checks. In the event of suspected violations of the legal provisions, the Office of Justice has the option of carrying out checks itself or having them carried out by an auditor.
The Office of Justice has recently issued guidelines for such checks.
